EOTAS explained in Wales: what it is, what it isn’t, and what to ask for

EOTAS (Education Otherwise Than At School) is one of the most misunderstood parts of the ALN system in Wales. Families are often told it is “rare”, “hard to get”, or only available in extreme situations — but that is not what the law says.

This guide explains what EOTAS actually is, when it should be considered, and how families can navigate the process with clarity and confidence.


What EOTAS actually is

EOTAS is a legal duty under Section 61 of the ALN Act. It applies when a child or young person cannot receive suitable education within a school setting — even with support.

This is not about preference. It is about whether the education system can meet need safely and appropriately.


What EOTAS is not

EOTAS is often misunderstood or misrepresented. It is not:

  • A last resort, only after prolonged failure
  • Something that requires a tribunal before being considered
  • A reduced or lesser form of education
  • The same as Elective Home Education (EHE)

When EOTAS should be considered

EOTAS should be considered when:

  • A child is unable to attend school due to distress, anxiety, or unmet need
  • Placement has broken down or is at risk of breakdown
  • A school cannot safely or effectively deliver the provision required
  • Attendance is significantly reduced or inconsistent

What EOTAS provision can include

EOTAS is not one fixed model. Provisions can include:

  • 1:1 tuition (in person or online)
  • Specialist therapeutic support
  • Alternative provision settings
  • Blended or phased approaches

The key requirement is that the provision is suitable to the child’s needs.


What to ask for

When discussing EOTAS, families should focus on:

  • Whether provision is suitable — not just available
  • How needs will be met in practice
  • Clear hours, structure, and outcomes
  • Named provision in the IDP
